A deed is a small document that decides large things. It determines whether a house goes through probate or passes the day after a death, whether a child can be added to a property without creating a tax problem, and whether the person who thought they owned something actually does.

Florida deeds: the short answers

What makes a Florida deed valid? The grantor must sign in front of two witnesses and a notary public. Florida’s two-witness rule sits in section 689.01, and homestead property also carries a spousal joinder requirement under the Florida Constitution.
Does a lady bird deed avoid probate? Yes. It transfers the property at death without probate, and the owner retains full control during life, including the right to sell or mortgage the property.
